Request to modify the decree : Timeline and content

At the end of December, the contracting parties concluded the negotiation of their collective agreement.

As provided in An act respecting collective agreement decrees, a request to modify the decree must then be sent to the Ministry of Labor so that aspects of having a monetary value are integrated into the decree. This request to modify the Decree was sent to the Minister of Labor in February for study and analysis.

Once the request has been transmitted to the ministry, the Parity Committee has no control of the delay for the entry into force of the decree.

Following the study by the Minister of Labor, the request must be pre-published in the Gazette officielle du Québec before it can be published and come into force.

Although the rate increases are never retroactive, the first increase generally comes into effect on the day of publication of the decree in the Gazette officielle du Québec, or on a later date if specified in the request.

Here are the increases that were negotiated, and remain subject to the approval of the Minister:

  1. On November 1, 2025, or upon publication of the Decree if it occurs after this date.

Other elements of the request if approved without modification:

    • Spreading out of working hours agreements cannot exceed 10 hours of the normal work week.
    • Compensatory indemnity for call-in, call-backs and hours worked during public holidays would increase from 3 hours to 4 hours.
    • Addition of a night premium of $0.25/h in the first year of the decree and increasing by $0.25/h each year up to a maximum of $1.00.
    • Reduction in RRSP contributions.
    • Addition of a mobile holiday in 2027 and a second in 2029.
    • Reduction in years of service necessary for the right to more than 3 weeks of vacation per year.
    • Harmonization with the new provisions of the Labor Standards Act regarding medical certificates.
    • Payment of accumulated sick leave credits upon retirement and permanent layoff.
